English
Preambolo
Gli Stati membri del Consiglio d’Europa, firmatari della presente Convenzione,
considerando che l’obiettivo del Consiglio d’Europa è di conseguire una maggiore coesione tra i suoi membri;
riconoscendo che l’uomo ha l’obbligo morale di rispettare tutte le creature viventi, ed in considerazione dei particolari vincoli esistenti tra l’uomo e gli animali da com pagnia;
considerando l’importanza degli animali da compagnia a causa del contributo che essi forniscono alla qualità della vita e dunque il loro valore per la società;
rando considered the difficulties caused by the wide variety of animals kept by man;
mindful of the risks inherent in pet animal overpopulation for hygiene, sa lute and safety of humans and other animals, whereas
the keeping of specimens of wild animals as pets should not be encouraged;
aware of the different conditions which govern the acquisition, maintenance, rearing to commercial or non-commercial use, transfer and trade of animals company;
aware that pets are not always kept under conditions that promote their health and welfare;
Noting that attitudes towards pet animals vary widely, sometimes because of limited knowledge and awareness;
whereas a basic common standard of behavior and practices that lead to responsible conduct by the owners of animals with companionship and an ambition not only appropriate but also realistic,
have agreed as follows:
Chapter I - General provisions
Article 1 - Definitions
1. By pet animal is meant any animal kept or intended to be kept by man, especially in his household for his beloved e compagnia.
2. Per commercio di animali da compagnia si intende l’insieme di transazioni ef fettuate in maniera regolare per quantitativi rilevanti ed a fini di lucro, che compor tano il trasferimento di proprietà di tali animali.
3. Per allevamento e custodia di animali da compagnia a fini commerciali si inten dono l’allevamento e la custodia praticati principalmente a fini di lucro per quanti tativi rilevanti.
4. Per rifugio per animali si intende un istituto a fini non di lucro nel quale gli ani mali da compagnia possono essere tenuti in congruo numero. Qualora la legislazione nazionale e/o le norme amministrative lo consentano, tale istituto può accogliere animali randagi.
5. Per animale randagio si intende ogni animale da compagnia senza alloggio dome stico o che si trova all’esterno dei limiti dell’alloggio domestico del suo proprietario o custode e che non è sotto il controllo o la diretta sorveglianza di alcun proprietario o custode.
6. Per autorità competente, si intende l’autorità designata dallo Stato membro.
Articolo 2 – Settore di applicazione e attuazione
1. Ciascuna Parte si impegna a prendere i necessari provvedimenti per conferire effetto alle disposizioni della presente Convenzione per quanto riguarda:
a) gli animali da compagnia tenuti da una persona fisica o morale in qualsia si alloggio domestico, o istituto per il commercio, l’allevamento e la custo dia a fini commerciali di tali animali, nonché in ogni rifugio per animali;
b) se del caso, gli animali randagi.
2. Nessuna disposizione della presente Convenzione è intesa a pregiudicare l’attua zione di altri strumenti per la protezione degli animali o per la preservazione delle specie selvatiche in pericolo.
3. Nessuna disposizione della presente Convenzione è intesa a pregiudicare la fa coltà delle Parti di adottare norme più rigorose al fine di assicurare la protezione degli animali da compagnia o l’applicazione delle seguenti disposizioni a categorie di animali che non sono espressamente citate nel presente strumento.
Capitolo II – Principi per il mantenimento pet
Article 3 - Basic principles for animal welfare
1. No one will cause unnecessary pain, suffering or distress to an animal with companionship.
2. Nobody shall abandon a pet.
Article 4 - Maintenance
1. Any person who keeps a pet animal or who has agreed to employ parsene will be responsible for its health and welfare.
2. Any person who keeps a pet or will deal, should the provisional DERE its installation and provide care and attention, taking into account the bi ethological dreams after his kind, and his race and in particular:
a) replenish sufficient food and water for its convenience;
b) provide it with adequate opportunities for exercise;
c) take all reasonable steps to prevent its escape.
3. An animal must not be kept as a pet if:
a) the conditions referred to in paragraph 2 above are not met, well
op b), although these conditions are met, the animal can not adapt to captivity.
Article 5 - Playing
Any person who selects a pet animal for breeding shall be obliged to take into account the anatomical, physiological and behavioral characteristics which are likely to endanger the health and welfare of proge nish or the female.
Article 6 - Age limit for purchasing
No pet animal shall be sold to anyone under 16 years with a sense without the express consent of parents or other persons engaged in the parenting responsibilities.
Article 7 - Training
No pet should be trained with methods that can dam age the personal health and well-being, in particular, forcing the animal to beyond its capacity or natural power, or by using artificial means to cause Healthy injury or pain, suffering and unnecessary anxiety.
Article 8 - Commercio, allevamento e custodia a fini commerciali, rifugi per animali
1. Qualsiasi persona la quale, all’atto dell’entrata in vigore della Convenzione, pra tichi il commercio o l’allevamento o la custodia di animali da compagnia a fini commerciali, o gestisca un rifugio per animali deve dichiararlo all’Autorità compe tente entro un termine adeguato che sarà stabilito da ciascuna Parte.
Qualsiasi persona la quale intenda praticare una delle predette attività deve farne dichiarazione all’Autorità competente.
2. Questa dichiarazione deve indicare:
a) le specie di animali da compagnia in oggetto o che saranno in oggetto;
b) la persona responsabile e le sue nozioni in materia;
c) una descrizione dei locali ed attrezzature che sono o saranno utilizzati.
3. Le attività di cui sopra possono essere esercitate solamente se:
a) la persona responsabile è in possesso delle nozioni e della capacità necessa rie all’esercizio di tale attività, avendo sia una formazione professionale, sia un’esperienza sufficiente per quanto riguarda gli animali da compa gnia;
b) i locali e le attrezzature utilizzate per l’attività soddisfano ai requisiti di cui all’articolo 4.
4. L’Autorità competente stabilisce, in base alla dichiarazione effettuata in confor mità con le disposizioni del paragrafo 1, if the conditions referred to in paragraph 3 are met or not. 5. The Competent Authority shall, in accordance with national law, check if the above conditions are met or not.
Article 9 - Advertising, entertainment, exhibitions, competitions and similar events
1. The pet may not be used for advertising, spectral Tacoli, exhibitions, competitions or similar events unless that:
a) the organizer has failed to create the conditions necessary for the treatment of these animals is in accordance with the requirements of Article 4 paragraph 2 and that

Article 10 - Interventions chirurgici

a) se un veterinario considera un intervento non curativo necessario sia per ra gioni di medicina veterinaria, sia nell’interesse di un determinato ani male;
b) per impedire la riproduzione.

Article 11 - Killing
1. All killing must be done with the minimum of suffering physical and moral differences in the circumstances. The method chosen, except in cases of emergency, shall:
a) both induce immediate loss of consciousness and then death;
b) both begin with the administration of deep general anesthesia if a proceeding that lowed by causes death is a certainty.
The person responsible for the killing shall make sure the animal is dead before the carcass is disposed.
2. Shall be prohibited and the following methods of killing:
a) drowning and other methods of suffocation if they do not produce the effects referred to in paragraph 1, subparagraph b;

Capitolo III – Misure complementari per gli animali randagi
Articolo 12 – Riduzione del numero di animali randagi
Quando una Parte ritiene che il numero di animali randagi rappresenta un problema per detta Parte, essa deve adottare le misure legislative e/o amministrative necessarie a ridurre tale numero con metodi che non causino dolori, sofferenze o angosce che potrebbero essere evitate.
a) Tali misure debbono comportare che:
i) se questi animali debbono essere catturati, ciò sia fatto con il minimo di sofferenze fisiche e morali tenendo conto della natura dell’animale;
ii) nel caso che gli animali catturati siano tenuti o uccisi, ciò sia fatto in conformità con i principi stabiliti dalla presente Convenzione.
b) Le Parti si impegnano a prendere in considerazione:
i) l’identificazione permanente di cani e gatti con mezzi adeguati che cau sino solo dolori, sofferenze o angosce di poco conto o passeggere, come il tatuaggio abbinato alla registrazione del numero e dei nominativi ed indirizzi dei proprietari;
ii) di ridurre la riproduzione non pianificata dogs and cats by pro move their sterilization

Article 13 - Exceptions for capture, retention and killing
Exceptions to the principles set out in this Convention for the capture, holding and killing of stray animals will be accepted only if unavoidable under the government programs of disease control.
Chapter IV - Information and education
Article 14 - Information and education programs
The Parties undertake a promuovere lo sviluppo di programmi d’informazione e di istruzione al fine di incoraggiare tra le organizzazioni e gli individui interessati al mantenimento, all’allevamento, all’addestramento, al commercio ed alla custodia di animali da compagnia, la consapevolezza e la conoscenza delle disposizioni e dei principi della presente Convenzione. In tali programmi, dovrà in particolar modo essere richiamata l’attenzione sui seguenti punti:
a) l’addestramento di animali da compagnia a fini commerciali o di competi zione, da effettuarsi da parte di persone con nozioni e competenze specifi che;
b) la necessità di scoraggiare:
i) il dono di animali da compagnia ai minori di 16 anni senza l’espresso consenso dei loro genitori o di altre persone che esercitano la responsa bilità parentale;
ii) il dono di animali da compagnia come premio, ricompensa, o omaggio;
iii) la procreazione non pianificata di animali da compagnia;
c) le eventuali conseguenze negative per la salute ed il benessere degli animali selvatici, del loro acquisto o inserimento come animali da compagnia;
d) i rischi derivanti dall’acquisto irresponsabile di animali da compagnia che porta ad un aumento del numero degli animali non voluti ed abbandonati.
Capitolo V – Consultazioni multilaterali
Articolo 15 – Consultazioni multilaterali
1. The Parties shall, within five years after entry into force of the Convention and thereafter every five years, and in any case, whenever a majority of the representatives of the Parties so request, hold multilateral consultations within the Council 's Europe to examine the implementation of the Convention and the advisability of a revision or extension of some of its provisions. These consultations will take place at meetings convened by the Secretary General if the Council of Europe.
2. Each Party shall be entitled to appoint a representative to participate in these consultations tions. Each State member of the Council of Europe which is not a Party to the Convention entitled to be represented by an observer in these consultations.
3. After each consultation, the Parties shall submit to the Committee of Ministers of the Council of Europe a report on the consultation and working with the Convention, including, if deemed necessary, proposals to bring ame heating in Articles 15 to 23 of the Convention.
4. Subject to the provisions of this Convention, the Parties shall establish rules of procedure for consultations.
Chapter VI - Amendments
Article 16 - Amendments
1. Any amendment to Articles 1 to 14, brought by a Party or the Committee of Ministers shall be communicated to the Secretary-General del Consiglio d’Europa che provvederà a trasmetterlo agli Stati membri del Consiglio d’Europa, ad ogni Parte, e ad ogni Stato invitato ad aderire alla Convenzione in conformità con le disposizioni dell’articolo 19.
2. Ogni emendamento proposto in conformità con le disposizioni del paragrafo pre cedente, è esaminato, almeno due mesi dopo la data della sua comunicazione da parte del Segretario Generale, nel corso di una consultazione multilaterale nella quale l’emendamento può essere approvato da una maggioranza di due terzi delle Parti. Il testo approvato è comunicato alle Parti.
3. Ogni emendamento entra in vigore alla scadenza di un periodo di dodici mesi dopo la sua approvazione in occasione a multilateral consultation, unless one of the Parties have notified objections.
Chapter VII - Final provisions
Article 17 - Signature, ratification, acceptance, approval
The present Convention shall be open for signature by member States of the Council of Europe. It is subject to ratification, acceptance or approval. The instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
Article 18 - Entry into force
1. The present Convention shall enter into force on the first day of the month following the expiration of a period of six months after the date on which four Member States of the Council of Europe have expressed their consent to be bound by the Convention with in accordance with Article 17.
2. The Convention will enter into force for any Member State which subsequently expresses its consent tively to be bound by the Convention on the first day of the month following the expiration of a period of six months after the date of deposit of instrument of ratification, acceptance or approval.
Article 19 - Accession by non-members
1. After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may invite any State not a member of the Council of Europe to accede to this Convention, by majority decision if condo Article 20 letter d) of the Statute of the Council of Europe and unanimously by the representatives of the Contracting States entitled to sit on the Committee of Mini Ministers.
2. The Convention will enter into force for each Member State, the first day of the month following the expiration of a period of six months after the date of deposit of its instrument of accession with the Secretary General of the Council of Europe.
Article 20 - Territorial clause
1. Any State may, when signing or depositing its instrument of ratification Pussy, acceptance, approval or accession, indicare il territorio o i territori ai quali si applicherà la presente Convenzione.
2. Ogni Parte può in qualsiasi momento successivo, tramite dichiarazione rivolta al Segretario Generale del Consiglio d’Europa, estendere l’applicazione della presente Convenzione ad ogni altro territorio indicato nella dichiarazione. La Convenzione entrerà in vigore nei confronti di detto territorio il primo giorno del mese successivo alla scadenza di un periodo di sei mesi dopo la data di ricezione della dichiarazione da parte del Segretario Generale.
3. Ogni dichiarazione fatta ai sensi dei due paragrafi precedenti potrà essere ritirata, per quanto concerne ogni territorio indicato nella predetta dichiarazione, mediante notifica addressed to the Secretary General. The withdrawal shall become effective on the first day of the month following the expiration of a period of six months after the date of receipt of the notification by the Secretary General.
Article 21 - Reservations
1. Any State may, when signing or depositing its instrument of ratification Pussy, acceptance, approval or accession, declare that use of one or more reservations in respect of Article 6 and paragraph to paragraph 1 of ' Article 10. No reservations may be made.
2. Any Party having made a reservation under the preceding paragraph may wholly or partly withdraw it by notifying the Secretary With General of the Council of Europe. The withdrawal shall take effect from the date of receipt of the notification by the Secretary General.
3. A Party which has made a reservation in respect of a provision of this Convention may not require pre-application of that provision to another party, but it may, if its reservation is partial or conditional, request the appli cation of this provision to the extent that it has itself accepted it.
Article 22 - Denunciation
1. Any Party may at any time, denounce this Convention by giving notice to the Secretary General of the Council of Europe.
2. The complaint will effect on the first day of the month following the expiration of a period of six months after the date of receipt of the notification by the Secretary General.
Article 23 - Notifications
The Secretary General of the Council of Europe shall notify the member States of the Council and any State which has acceded to this Convention or is to be asked to do so:
a) any signature;
b) the deposit of any instrument of ratification, acceptance, approval or accession;
c) any date of entry into force of this Convention in accordance with Articles 18, 19, 20 of the Convention;
d) any other act, notification or communication relating to this Convention.
In witness whereof the undersigned, being duly authorized thereto, have signed this Convention pre.
Done at Strasbourg on 13 November 1987 in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe Council. The Secretary General of the Council of Europe shall transmit certified copies to all Member States of the Council of Europe and any State invited to accede to this Convention.
